Please read these Terms of Service carefully before using our Website. If you do not agree to these Terms of Service, please refrain from using our Website.

This Website is owned and operated by Julie Kegels, with registered office at Hessenplein 2, 2000 Antwerp, Belgium and registered with the Crossroads Bank for Enterprises under company number BE08034974 (“Julie Kegels”, “we”, “us” or “our”). 2. Acceptance of Terms of Service

By using this Website and purchasing products from us, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, as well as any other policies referenced herein. We reserve the right to modify these Terms of Service at any time upon prior notice on the Website. Your continued use of the Website constitutes acceptance of the changes. Other terms and conditions (including of those of the customer) are not applicable and are expressly excluded.

3. Eligibility

To use our Website and purchase products, you must be at least 18 years old or have the consent of a parent or guardian. By placing an order, you confirm that you meet this requirement.

4. Products and orders

Our Website offers a range of products, which can be viewed and purchased online. All products are subject to availability. We reserve the right to discontinue the offering of any product at any time.

4.1 Placing orders

To place an order, add the desired products to your cart and proceed to checkout. The customer acknowledges that he has been informed of these Terms of Service prior to the placement of an order, that these Terms of Service are clear and understandable and that he has accepted all provisions thereof. These Terms and Conditions are accepted by the act of acceptance of a clickwrap agreement (i.e. the clicking the box “I agree” before placing the order). You will be required to provide accurate contact and payment information. Once your order is received by us, you will receive an email notification. An agreement is only concluded once the order has been expressly accepted by us.

4.2 Order acceptance

We reserve the right to refuse any order within ten (10) calendar days after the e-mail notification indicating receipt of the order. If your order is cancelled, you will be notified via email and refunded accordingly within 7 calendar days.

The illustrations, dimensions, weights, product descriptions and options displayed on the Website have been created with the utmost care. However, they are only approximate, purely informative, and provided without obligation.

We may offer new products for sale that are not yet in stock, or existing products that are no longer available, allowing customers to pre-order those products. When pre-ordering, we will provide an estimated availability date on the relevant product page. This date is only indicative and is not binding on us.

5. Pricing and payment

All prices listed on our Website are in euros and include Belgian VAT. Prices may be subject to change without notice. If the price changes after an order confirmation, it will not be applicable to that order. Payment can be made using the methods specified at checkout. The customer’s bank account will be debited once the order is confirmed.

All amounts due by the customer must be paid immediately upon placing the order. The payment methods accepted are listed on the Website during the ordering process.

6. Shipping and delivery

6.1 Delivery options

The customer has the option to have the product(s) delivered at home. The products will be delivered based on the delivery options chosen by the customer during the ordering process. Delivery will be managed by a third-party delivery service provider (the “Carrier”). The delivery date indicated on the Website is indicative.

The delivery address will be the one provided by the customer during the ordering process. We will not be held responsible for any issues arising from incorrect or incomplete information provided by the customer. If the product needs to be reshipped due to an incorrect or incomplete delivery address, any additional costs incurred will be charged to the customer.

If no one is present to receive the order, the Carrier will leave a message. The customer must follow the instructions on this message to pick up the order at a later time. If the customer does not pick up the order according to the Carrier's instructions, the products will be returned to us. In that case, the customer can contact us to arrange a new delivery, for which additional delivery costs will be charged.

6.2 Shipping costs

Shipping costs are calculated based on delivery method selected by the customer and will be displayed at checkout.

6.3 Risk of loss

All products purchased from our Website are made pursuant to a shipment contract between the customer and the Carrier. This means that the risk of loss and title for such items pass to the customer upon our delivery to the carrier.

7. Returns and cancellations

7.1 Right of withdrawal

You have the right to withdraw from your purchase within fourteen (14) days from delivery of the products without providing any reason, if the products are in perfect, unused conditions. To exercise this right, you must notify us via email at e-comm@juliekegels.com.

7.2 Return process

Products must be returned in their original condition and packaging within fourteen (14) days from notifying us of your withdrawal. The customer is responsible for the cost of return shipping. Upon receipt and inspection of the returned products, we will issue a refund for the purchase price, excluding the original shipping costs.

We are not required to accept the return of a product that is sent back after the withdrawal period or without adhering to the specified return procedure, including items showing signs of use. We will determine whether a product qualifies for return. Upon request, the reasons for rejecting a return will be communicated to the customer.

8. Intellectual property

We (or our licensors, if applicable) shall at all times retain all titles, interests and rights, including but not limited to any Intellectual Property Rights, in and to our Website and all content related thereto. “Intellectual Property Rights” means any and all now known or hereafter existing (a) copyrights, copyrightable works (including but not limited to text, images, designs, videos) and moral rights, (b)trademarks (whether registered or not), service marks, trade dress, trade names, signs, logos, corporate names, Internet domain names, designs, design rights, advertising rights and registrations and applications for the registration thereof, (c) patents, patent disclosures, and inventions (whether patentable or not) and industrial property rights, (d) computer software programs (including but not limited to source code and object code), data, databases, database sui generis rights and documentation thereof, (e) trade secrets, know-how and (confidential) information (including but not limited to ideas, information, improvements, specifications, drawings, programmer notes, discoveries and proposals, layout design rights, design rights, and other proprietary rights of every kind and nature, and (g) all registrations, applications, renewals, extensions, or reissues of the foregoing, in each case in any jurisdiction throughout the world.

The customer may not reproduce, distribute, or use any content without our express written permission.

9. Privacy and data protection

We are committed to protecting your privacy. Please duly consult our Privacy Policy, which explains how we collect, use, and protect your personal information, as available at our Website. By using our Website, you consent to our Privacy Policy.

10. Legal warranty

10.1 Notification of defect and return of products

The customer has a statutory warranty of two (2) years from delivery of the products to the customer. In case of a defect in the products, the customer must inform us via e-comm@juliekegels.com within a reasonable time and at the latest within the two (2) months after the defect is known by the customer. If a defect occurs within the two (2) year statutory warranty period, the customer can return the products to us no later than fourteen (14) calendar days after notifying us of the defect. All costs for returning the products shall be borne by us.

10.2 Remedies

After the customer has returned the defective Products to us, we shall provide the customer with new products within a reasonable time. The products can only be replaced and delivered to the extent they are still available. If the replacement is not possible or cannot be performed within a reasonable time, the customer has the right to cancel the related order and we will refund the price and shipping costs for the products to the customer.

11. Limitation of liability

We strive to ensure the accuracy of all information on our Website. However, we provide the Website on an ‘as is’ and ‘as available’ basis. We make no representations or warranties of any kind, express or implied, as to the operation of the Website or the information, content, materials, or products included on the Website. We reserve the right to withdraw or delete any information from the Website at any time. To the full extent permissible by applicable law, we disclaim all warranties, express or implied, including, but not limited to, implied warranties of truthfulness, completeness, accuracy merchantability and fitness for a particular purpose. We do not warrant that the Website is free of viruses or other harmful components.

We are only liable for direct damages (not for indirect or consequential damages) resulting from the use of our Website or products, which are directly and solely attributable to us. To the maximum extent permitted by applicable law, the aggregate liability of us, our affiliates and subcontractors arising out of or related to these Terms of Service and (accepted) orders will not exceed the total amount paid by the customer under the Agreement during the twelve (12) months immediately preceding the date of the event giving rise to such claim. Multiple claims shall not enlarge this limitation. Nevertheless, nothing in the Agreement shall limit or exclude our liability for gross negligence, willful misconduct, or fraud.

We are not liable for failure to perform under these Terms of Service if such failure is due to unforeseen circumstances beyond our reasonable control (i.e. force majeure), including but not limited to floods, fire, strikes, labour disputes or other industrial disturbances, (declared or undeclared) war, embargoes, blockades, riots, insurrections,pandemics, epidemics, cyberattacks, legal restrictions, governmental regulations, telecommunications-, network-, computer-, server-, or internet-downtime, transportation interruptions or accidents.

We cannot be held liable for cancellation of an order due to stock shortages, however, in this case the customer will receive a full refund for the cancelled products.

12. Governing law

These Terms of Service and any disputes arising from your use of our Website or purchase of our products shall be governed by and construed in accordance with the laws of Belgium. Any legal actions related to these Terms of Service shall be brought in the courts of Antwerp, division Antwerp, Belgium.

Whenever possible, the provisions of these Terms of Service will be interpreted so as to be valid and enforceable under the applicable law. However, if one or more provisions of are found to be invalid, illegal or unenforceable (in whole or in part), the remainder of the provisions of these Terms of Service will not be affected and will continue in full force and effect. In this case, the invalid, illegal or unenforceable provision(s) or any part thereof will be replaced by a new provision that embodies as closely as possible the purpose of the invalid, illegal or unenforceable provision(s).
